ASG Course Participation Terms and Conditions

Anderson Software Group, Inc. (ASG) offers Course Events for technical training given at University of Mary Washington University Dahlgren Campus. A Course Participant is anyone who purchases a Seat for a Course Event offered through the ASG website at asgteach.com/events. All Course Event Seats must be purchased and paid in full before attending. Course Participants will be asked to provide the appropriate ticket for the specific Course Event on the first day of class. There are no refunds or reduced payments for no-shows.

ASG agrees to provide training as described in the online Course Event listing, with live instruction. ASG provides laptops for Course Participants for working through the hands-on exercises. The laptops are available only during class hours (typically 8:00am – 4:00pm) and may not be removed from the classroom. Every effort will be made to provide a laptop for each student, although at times it may be necessary for students to share laptops. Furthermore, Course Participants agree to not alter the software on the laptops, except for working through the provided in-class exercises. Course Participants also agree to not install any malware on the machines or abuse the machines in anyway. Course Participants may use their own laptops, with prior approval of the instructor. Approval depends on the particular Course Event and the software configuration required for the Course Event.

Cancellation of Courses

ASG reserves the right to amend or cancel any Course Event, Course times, dates or published prices. Changes to Course Event prices, times and dates will be advised before the Course Event start date and any Course Event already paid will not be subject to the increased price. As a Course Event may be cancelled up to four weeks prior to its start date, ASG recommends that Course Participants not make travel or accommodation arrangements before this time.

Any travel or accommodation costs incurred are entirely the participant’s responsibility. ASG does not accept any liability for reimbursement of any costs incurred whatsoever in relation to its training Course Events.

Where a Course has been cancelled, Course Participants will be offered an alternative date for the same Course Event, a credit towards another Course Event, or a refund.

Cancellations by Participants

All cancellations requests must be received in writing using email through the Contact Us link at http://asgteach.com/contact-us/. When a Course Event Seat has been purchased and is subsequently cancelled by the Course Participant, the Course Participant will be liable for the following charges.

Transfers

In the event that a participant wishes to transfer a Course Event Seat to another Course Event, a 10% administration fee will be charged if the transfer is requested between three to five weeks of the original Course Event date. For transfer requests made three weeks or less prior to the Course Event date, no refund can be made. Transfers can be made to any event within a 6-month period. All transfers must be requested in writing using email through the Contact Us link at http://asgteach.com/contact-us/.

Substitutions

Course Participant substitutions may be made at any time before the Course Event begins. The new participant must provide the appropriate ticket at the Venue on the first day.

Refunds

If you wish to cancel a Course Event Seat, ASG will refund the fees paid according to the above cancellation policy. If payment for the order was originally made by credit card, any refund will be made back to the same card. If payment for the order was made by another method, such as Paypal, a refund will be made by through the same payment gateway.

Status of Intellectual Property and Copyright Information

Course Participants acknowledge and agree that ASG exclusively owns all intellectual property rights in ASG Courseware, and nothing in the purchase of a Course Seat of any ASG Course Event constitutes a waiver, assignment or transfer of the rights of ASG under any state, provincial, federal or other law or international treaty. Any and all rights not expressly granted herein shall be reserved for ASG. In particular, the Course Event notes may not be used or duplicated in any format (including electronic) for any purpose outside of the ASG Course Event without prior written consent from ASG.

Disclaimer and Limitation of Liability

ASG disclaims any and all representations and warranties with respect to ASG courseware, either express or implied including, but not limited to, third party infringement, implied warranties of merchantability and fitness for a particular purpose. Course Participants may not rely on any representation or warranty made by ASG or any other person. ASG courseware is provided on an “as is” basis with no warranty or representation, express or implied, and ASG has no obligation to provide maintenance, support, updates, enhancements or modifications with respect to ASG courseware to Course Participants.

In no event shall ASG be liable for any damages suffered or incurred by Course Participants or any other person or entity including, without limitation, any special, incidental, indirect, direct, punitive or consequential damages whatsoever (including, without limitation, damages for loss of business profits, loss of revenue, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use ASG courseware.

By purchasing a Course Event Seat, Course Participant acknowledges and agrees that the limitations of liability set out in these terms and conditions are fair and reasonable and that ASG would not have entered into this agreement nor provided ASG courseware to Course Participant but for Course Participant’s agreement to limit ASG’s liability in the manner, and to the extent, provided for herein.
